Biography

Attorney Densberger previously served as a Program Analyst for the United States Department of Labor in the area of health care fraud and abuse. She is a recipient of the United States Department of Labor Secretary’s Honor Award for 2014. She has held prior positions as corporate legal counsel to a large hospital system in Massachusetts and to a major managed care system in Minnesota and has also served as a Case Law Editor for LexisNexis. She currently holds an appointment as Lecturer in the LLM Degree program/Graduate Tax Program at Boston University School of Law and an appointment as Adjunct Professor of Health Law, Policy and Management at Boston University School of Public Health where she has been twice awarded the Dean’s Excellence in Teaching award. Attorney Densberger also holds an appointment as Adjunct Professor at Suffolk University Law School where she teaches a course on ERISA and qualified retirement plans and at the University of Nevada Boyd School of Law as an instructor in Public Health Policy. She is licensed to practice law in the states of Massachusetts, New York, and Minnesota and is also admitted to practice before the U.S. Supreme Court, U.S. Court of Appeals for the First Circuit, and U.S. District Court for the District of Massachusetts.

ERISA and the IRC: Regulation of Retirement Plans

2 credits

This course provides an introduction to the regulation of retirement plans covered under the Employee Retirement Income Security Act of 1974 ("ERISA"), a federal law that transformed the legal landscape of private-sector retirement plans. Specifically, the course will cover public policy implications of offering and regulating retirement plans including tax policy concerning incentives for employers to offer retirement plans and for employees to defer income to these plans, the different types of retirement plans subject to regulation under ERISA with a focus on defined contribution plans such as cash or deferred arrangements (401(k) plans) under the Internal Revenue Code, how plans qualify for preferential tax treatment under the Code, federal preemption of ERISA-governed benefit plans, ERISA's fiduciary duties and prohibited transaction rules, and civil enforcement in the courts as well as by the Internal Revenue Service and the Department of Labor. The course will be relevant for any student interested in employee benefits, tax law, employment law, labor law, business law, or securities law. JD students are not permitted to enroll in the online section of any tax courses without receiving prior approval from the Assistant Dean for Graduate, International, and Online programs.

Health Systems, Law, and Policy

4 credits

Policies and laws strongly influence health outcomes at individual and population levels. This course examines the constitutional, regulatory, policy, and socio-economic foundations for federal and state policies that determine access, quality, cost, and equity in health services and population health programs. Students gain a comprehensive understanding of processes from policy development through implementation in the public and private sectors. While the course primarily focuses on U.S. examples, it complements the World Health Organization’s framework for organizing and analyzing national health systems.
