Biography

Anja von Rosenstiel is a mediator by training and practicing attorney both in Boston and in Vienna, Austria, licensed in Massachusetts and in Germany, specialized in banking, securities, fintech, and corporate law, with a particular focus on blockchain and digital assets. She is currently in private practice and advises as senior counsel at Ernst & Young Law, Pelzmann Gall Gröss Rechtsanwälte GmbH. She regularly participates as a professional in the International Mediation Competiton at the International Chamber of Commerce in Paris.

Next to teaching ADR and negotiation at BU Law School’s American Law Program, Anja is co-director in the Single Supervisory Mechanism Online Master Program for European Banking supervision experts at European University Institute in Fiesole.

After obtaining an LLM in American Law from BU in 2018, she completed a federal clerkship at the United States District Court for Massachusetts, which she finished in 2019. Anja was admitted to the Massachusetts Bar in 2020.

Anja has authored numerous articles about ADR, in particular blockchain dispute resolution, and crypto- and fintech related topics in legal journals. She is co-author of several books, including on a handbook on the Market in Crypto-Asset Regulation (MiCAR), a handbook on decentralized autonomous organizations and a fintech handbook soon to be published.

ADR for LLMs

3 credits

The goal of this course is to improve the ability of internationally-trained LL.M. students to resolve disputes and to productively engage in conflict. In this highly interactive class, students will examine a variety of dispute resolution processes, other than traditional court adjudication, including negotiation, mediation, arbitration, dispute system design and restorative justice. Over the course of the semester, students will engage in a series of exercises (i.e., role-plays) through which they can develop and hone their skills and approaches to dispute resolution. Discussion and short lectures will accompany the exercises, as appropriate. There will be short written assignments as well as a longer paper due at the end of the semester. No final exam. ENROLLMENT LIMIT: 18 students.
