Jessica Silbey will speak at Harvard Library Copyright First Responders: Is Controlled Digital Lending Doomed? A panel discussion about Hachette v. Internet Archive and of access to knowledge under the law on Tuesday, October 24. The event will be held in the Thompson Room in the Barker Center from 12–1pm, and is hosted by the Harvard Library Copyright First Responders.
The Internet Archive’s controlled digital lending program has been seen as a harbinger of a new pathway forward for libraries to provide broader and more equitable access to their collections through controlled digital lending (CDL). But in March of 2023, Internet Archive suffered a major loss before a federal district court in its fair use defense of CDL. Internet Archive has now filed an appeal. In the meantime, libraries, authors, and publishers must grapple with what this suit means for both their immediate future and for long-term access to knowledge.
