Self-Regulation and Certification: An Appropriate Tool to Regulate Platforms and AI-Industries

This talk, given by Dr. Yaniv Benhamou, attorney-at-law and lecturer at the University of Geneva, assumes that self-regulation and certification mechanisms may be an appropriate tool to regulate the platforms and AI-industries, as they may ensure flexibilities and possibly transparency and ethics. Their legal nature and standard-setting processes however, are unclear (one can think of the Facebook ToS, or the ACM code of ethics described sometimes as the Hippocratic oath for computing professionals): are endorsers exempted from liability (safe-harbor)? How can we ensure an adequate and transparent standard-setting process? This paper brings these questions up-to-date. The talk aims at presenting a work-in-progress paper on this subject, mainly from the standpoint of European data protection law.

Prior to the presentation, as an example of self-regulation, Dr. Benhamou will briefly present The Geneva Internet Dispute Resolution Policies 1.0 (GIDRP 1.0), a project detailing policy proposals on Internet and IT-related disputes, in particular on jurisdiction (Which national courts shall have jurisdiction in Internet-related disputes?) and ADR (How to structure an alternative dispute resolution system for Internet-related disputes?).
