Investigation

Boston University is committed to creating a respectful and inclusive living, learning, and working environment. When a concern is raised, EOO conducts a fair and thorough investigation. This process includes gathering relevant information, speaking with involved parties, and reviewing applicable policies. Our goal is to ensure all voices are heard and that appropriate steps are taken to address the issue.

Notice

The investigation begins when EOO issues a Notice of Investigation and Allegations (NOIA) outlining the allegation(s) being reviewed, explaining the investigation process, and identifying the investigator.

Initial Outreach

The investigator schedules individual meetings with the parties. All EOO meetings are voluntary and parties may bring an advisor or person of support.

Interviews

A big portion of the investigation involves interviewing parties and witnesses. While the parties can recommend witnesses, the investigator determines who to interview based on whether they have potentially relevant information.

Evidence Collection

In addition to conducting interviews, the investigator may request and review documentary evidence, including emails, text messages, videos, etc…

Preliminary Review

Parties have an opportunity to review and comment on a preliminary investigation report, which summarizes the relevant evidence. Based on the parties’ feedback, the investigator will update the report and may conduct additional investigatory steps.

Final Report

An administrator receives and reviews the final report. Following that review, the parties are provided access to the final report. For non-Title IX allegations, the final report includes factual findings and a determination as to whether BU policy was violated.

Hearing (if applicable)

For reports of sexual misconduct that fall under the 2020 Title IX regulations, a live hearing is required after the final report is issued. The Hearing Panel makes factual findings and determines if the Policy was violated.
