  1. I fully understand that when you are in a public space you are subject to being captured in pictures/video. It happens. Also, at least in the US, there is no expectation of privacy in public spaces. The photographer is the owner of the pictures, not the subjects

    Given that, I am not taking DIRECT pictures/video of a stranger unless it’s clear that it’s ok (e.g., a juggler performing at a park for people). This is especially true of children.

    If the subject of the article was taking a nature video and they happen to catch this moment, that’s fine, but the subject had an intended subject (the couple) and then posted it online. What if the couples family recognizes them, but the couple didn’t want to reveal their engagement for a while? What if the woman said “no”, but they weren’t going to share the proposal attempt to prevent embarassment?

    So, I think the discussion should be about: 1) Are the people in the picture/video the focus or was it incidental. 2) Is then sharing it, without permission, OK. Our laws do need to get updated, but I can see why the law is set the way it is. If there is a right to privacy in public space, can you imagine the amount of lawsuits anytime someone takes a picture in public, especially at a crowded venue? It would be disasterous for the photographer and the courts. The upside would be to the lawyers and if the plaintiff received money.

    So, this will remain a morality question more than a legal one.
