Sjt Fortescue said before that the essoin was quashed: because where the party had an attorney in Court, that he will never be essoined of (being) overseas, or (going) to the Holy Land, therefore (he would not be essoined) for service to the king
Sjt Markham: Essoin of sick bed lies for the party well enough even though he had an attorney in Court
Newton CJCP: This is true: the reason is because this essoin never lies except only in a writ of Right, and there no one can join the Mise on the pure (mere) right except solely the attorney's client (Maistre)

Statham Essoin 50 stated that an essoin 'de malo lecti' should be cast for the tenant, although there was an attorney in the plea; and so it seemed that it should be for every essoin, except a common essoin, etc.
