Tenant (defendant) pleaded that her father and mother levied a fine by which they granted to A. who granted back to them in fee tail, and after their deaths tenant entered as daughter and heir.
Plaintiff replied that a prior fee tail descended to plaintiff wife as daughter of tenant's mother and her first husband, and tenant (defendant) disseised plaintiffs.

Sjt Yelverton and Sjt Fortescue argued for plaintiff's position; Sjt Portyngton and Paston JCP argued for defendant's position
Tenant (defendant): a fine was levied between tenant's father and tenant's mother Alice of one part, and A. of the other part, by which fine tenant's father and mother granted, etc. to A. who granted and rendered back to them in tail, and tenant's father and mother Alice died, and tenant entered as daughter and heir
Plaintiffs: long before this fine was levied, V.D. was seised, and gave the same land to J. Irby and Alice his wife, mother of tenant, and to the heirs of the said Alice engendered, among whom K. is issue, and then J. Irby died and tenant's mother Alice married tenant's father, and they had issue the tenant and they died, and the tenant entered within age claiming to her use and to the use of K. her sister, in which case this was remitter of the one half, by force of which the plaintiffs entered as in right of the wife (half-)sister of the tenant, claiming to hold this half in coparency, and thus were seised until disseised by the tenant
Newton CJCP: if I alienate late with a warranty, which is worth 40 shillings (= 2 pounds), and then by mining of lead or tin found in the same land the value is made 40 pounds per year, if the tenant be impleaded and vouch me, and I appear at Grand Capias, and cannot bar the demandant, I will take issue with the tenant for what value the land had at the time of the warranty, and not render more in value |

Statham Remittere 5, an extremely long entry, identified the plaintiffs as James Kelomme and his wife K., defendant as Eleanor (alianore), the father (of Eleanor) as W. and mother (of Eleanor and K.) as Alice, the donor as H., the earlier donor as D., the donee and first husband of Alice as J.; attributed a second speech to Ayscough JCP; stated that Sjt Fortescue said that if one half were discharged, all was discharged; and stated that all the Bench held clearly tha tthe entry of the plaintiff was not lawful, and the plaintiff, seeing this opinion, etc. was nonsuited, and brought Formedon in both their names, etc; well argued
Statham Garrantie 19, a long entry, identified this as the Assize of Kelomme; reported Newton CJCP's opinion; mentioned lands of which the value was increased by tin, lead, or coal (Tynne, lede ou coles); and added but yet query, because it seemed that the collateral warranty in the case above was defeated when the issue in tail was in by descent, as well as if the issue in tail brought a Formedon and recovered, where that collateral warranty was not pleaded in bar, then he was in (in) his own right and the warranty was defeated; and ended with a query. |
