Defendant receivers (accessories) pleaded that the indictment did not prove that they knew defendant principal was a thief, and that they could not take goods with force and arms from themselves.
Cheyne CJKB said that defendant receivers' knowledge was not stated in the indictment, and then told defendant receivers that they were dismissed (go adieu). |

According to Sjt Newton in 1429.033 = Pasch. 7 Hen. 6, pl. 27, fol. 31b-33b, William Waw, thief, was taken out of the Sanctuary of Bewley.
Arguments about the 'scienter' requirement in receiving.
It was said, and 'Norton' (Sjt Newton?) said that it was law, that one could retake one's own goods feloniously from one's bailee, and one will be hanged, yet the property of the goods was in one.
