Plaintiff recovered in Detinue against the garnishee, and before execution of the judgment had delivery of the deed of Statute Staple out of here, and execution by force of the Statute out of Chancery on defendant's goods, chattels, lands and tenements, and plaintiff also had Capias to take defendant's body, returnable in Chancery.
Capias issued to the same sheriff in another suit to take defendant's body, returnable in King's Bench
The sheriff returned in King's Bench that he had taken defendant's body on both suits.
Counsel for the garnishee argued in King's Bench that the garnishee had sued a writ of Error to reverse plaintiff's recovery in Detinue and so should be dismissed in Chancery.
Hals JKB said that King's Bench had no power to dismiss the garnishee, but told his counsel to show this to the Chancellor. |

Sjt Rolf: covient que cest cas soit doubtful, car s'il fera sans recovery il sera inconvenient l'ou le premier Jugement fuit errone; Ceo fuit 'ex cautela'
Et fuit dit, que si le defendant en le premier brief ust livere le fait al' testator ou ses executors de son tort demene, que il aura vers luy brief de Deceit, & nemy brief de Detinue: car les conditions provent que le livere n'appertient a M. |
