Plaintiff counted that defendant sued an original writ of Debt at Westminster against plaintiff in the name of M. without the assent or will of M., by which suit plantiff was vexed and put to great costs.
Defendant pleaded that M. retained defendant to be of his counsel and prayed him to sue plaintiff at Bristol, and as to the rest pleaded an arbitration at B.
Plaintiff replied that he need answer only to the arbitration, and that defendant should plead in the negative.
Cheyne CJKB told plaintiff to delay himself.
Plaintiff willingly replied that there was no submission to arbitration.
Issue joined.
A jury (Pais) of B. was awarded, where the arbitration was alleged.
As to the other plea, plaintiff replied that defendant sued the original writ as plaintiff had supposed, without the assent or will of M.

Mecheley: nous avons assigne nostre grievance, entant que il suit cest brief en auter nom sans sa assent; il semble que l' arbitrement va a tout: car per l'original nous ne sumus pas greves, eins par le Capias: par quel nous sumus enprisones, & per l' Exigent, car si nient plus ust este fait, eins l'original brief purchas, nous ne serons jamais greves, issint l'arbitrement purge tout en que nous sumus greves
Hals JKB: 'absque voluntate' est un mere negatif, le quel est un responder par affirmatif, les queux sont un bon issue; Et auxy coment puisses vous aver este greves per le judicial, si l' original n'ust este? 'Nullo modo'

Mecheley (for P): by the original writ we were not aggrieved, but by the Capias by which we were imprisoned, and by the Exigent, because if nothing more had been done, but purchase of the original writ, we would never be aggrieved; thus the arbitration would purge all in which we were aggrieved
Cheyne CJKB: In a writ of Trespass with force and arms, the defendant ought to answer to the coming with force and arms, and yet if he be excused against the party of the rest, he will be excused against the king of the coming with force and arms, and it will not be inquired by the inquest; it is otherwise in an Assize; thus here, perhaps he will be make a fine to the king for the contempt, so he ought to answer to the suing of the original |
