Process and Pleading
Tenant (defendant) pleaded that he had the estate in fee and that demandant's (plaintiff's) ancestor was a tenant at will.
Demandant (plaintiff) replied that his action was in the nature of an assize, and tenant had given him no color.
Demandant (plaintiff) passed over and claimed the fee by a fine from two donors.
Adjournment.

Sjt Westbury (for D): R.H. was seised of the fee and enfeoffed Thomas C. and R.F. in fee. Thomas C. and R.F. leased to J. Charite to hold at their will. J. Charite died, then Thomas C. and R.F. entered, whose estate tenant (defendant) W. Colard had. Demandant (plaintiff) Robert Charite, as cousin and heir to J. Charite, supposed that J. Charite died seised of the fee, entered on tenant, and tenant reousted demandant.
Sjt Strangeways (for P): R.H. was seised of the fee and enfeoffed Thomas C. alone. A fine was levied between C. (must be demandant Robert) C. as plaintiff and N.C. and his wife A. deforceants, by which N.C. and his wife A. acknowledged all their right to be the right of demandant (plaintiff) Robert Chartie. in fee, as R.C. had of their gift. Then R.C. was seised until disseised by tenant (defendant) W. Colard. Then Thomas C. by the deed shown by demandant (plainitff) released all the right that he had in the land to R.C.
