The opposite result was reached in a nearly identical situation in 1413.030 = Hil. 14 Hen. 4, pl. 30, fol. 23b-24a and also 1412.002 = Hil. 13 Hen. 4, pl. 2, fol. 12a-12b. Brooke Respondre 15 reports the result in this case and 1413.037 = Hil. 13 Hen. 4, pl. 37, fol. 27b-30a, but dates it 14 Hen. 4.1410.020 = Hil. 11 Hen. 4, pl. 20, fol. 45b-47a |

Statham Detenu 23, a long entry, added that the detinue was the cause of action, and for charters it appeared that one should have a writ of Detinue without a specialty, because the testator could not wage his law, etc.
Jenkins 78 (2nd century, case 51), 145 Eng. Rep. 55: 14 H. 7, 27. 21 H. 6, 1. 39 E. 3, 5. By the judges of both Benches. Detinue is brought against two executors for goods left in the possession of the testator; one of them appears upon the distress 2 the other makes default: he who appeared shall answer without the other, by the equity of the statute of 9 E. 3, ch, 3, which makes this provision in debt against executors. Ubi eadem ratio est, ibi eadem lex. Executors by representation are the same person with the testator. |
