In an array of an Assize of Novel disseisin, made by the bailiff of a franchise, some were challenged because they were villeins, which challenge was adjudged good. A speaker said that the bailiff had summoned others who were not in the panel, and he prayed that the bailiff be charged to say who they were, and upon this it was said (Latin begins) that none etc. (Latin ends). The same speaker said that several who were summoned were here (ceans). A serjeant asked which, and one was named and charged if etc., who said no. The same serjeant (perhaps an Assize Justice) said to the bailiff that, because he had returned several villeins, by reason of which the assize remained, he would be amerced. And the Non omittas was awarded.
