Alice, widow of Simon of Mordon, sued this scire facias against Margaret of F. and against R. of Walton, as against separate tenants, to have execution of certain tenements by force of a fine which was levied in the time of Edward I between Simon of Mordon and his wife Alice, complaints, and Thomas of Lire, deforciant, by which fine Thomas granted and rendered the tenements to Simon, to have and to hold to Simon and Alice and to the heirs that Simon engendered of the body of Alice. Margaret said that, as to the tenancy that she held, she had nothing except in dower, and the reversion belonged to Richard, without whom she could not be party to this execution, and she prayed aid of him. As to Robert, she said to see clearly how in this fine there was no executory word except the render, and the render was not made to Alice, but solely to Simon, judment if the plaintiff should have execution. |
