Note, in a plea of land the suit remained without day, and afterwards the plaintiff sued a resummons returnable now on this day. The sheriff returned that he had not resummoned the tenant because he had divested himself of the land a long time before the writ came to him. As a result of this, the plaintiff prayed a writ to the sheriff to summon the tenant in the land in demand. Herle CJCP granted him the writ, and also a day of grace, although this was a plea of land, but the sheriff was not amerced, because he was another sheriff than the one to whom the original writ had first come.
