Sutherland: If a vouchee enters into warranty and afterwards defaults, the Cape should issue for seizure of the tenements being sued for, not the Cape ad valenciam against the warrantor's tenements. Upon such a default the court mistakenly issued the Cape ad valenciam but when a nihil was returned thereto on the next day it rectified its error and issued the Cape against the tenements being sued for.
