Sutherland: A minor brought an action of formedon in the descender, tracing the descent of the entail from his grandfather through his father to himself. The tenant proffered a deed of release from the demandant's father, with warranty. The demandant aragued that this was no answer, since in formedon in the descender a lineal warranty is no bar without a further allegation that the demandant has assets by descent in fee simple. The tenant argued that it was an answer sufficient at least to delay the case until the demandant came of age, since he had shown a deed of the demandant's ancestor to which the demandant could not plead, to acknowledge or deny it, while he remained under age. No judgment was given. |
