Sjt Herle (for P): Nay, ore est autre chose (MS: ore), Avice morte, qe fetes vous ore?
Postea predictus Ingelranus conquestus fuit W. Howard JCP, qui tunc nn fuit in Banco, quod non potuit audiri in isto placito, qui fecit revocare partes
Sjt Herle (for P): Jeo lui respond com W. (William Herle) mes noun pas com partie
Howard JCP: e si ele lui defend de manger, de ceo quei

a case where a tenant by the curetsy (by the law of England) alleged against the plaintiff that she detained the charters &c. and it was not allowed
Sjt Herle (for P): Nay, now here is another thing, now Avice is dead, what are you doing now?
King's Sjt Warrewik spoke again as a Justice: (to Sjt Hedone (for D)) even if you had the charters, the heir of Avice would deraign them out of your hand in spite of you, so it appears that they do not belong to you
Afterwards (defendant) Ingeram complained to Howard JCP, who was not them in the Bench, that he was not able to be heard in the plea, and he (Howard JCP) recalled the parties
Sjt Hedon (for D) pleaded his exception &c.
Sjt Herle: I answer him as W. (William Herle) but not as party
Howard JCP: why?
Sjt Herle: because judgment has been given, but for your satisfaction I tell you that about the charters he says what he wishes, we do not have them, but they are in another person's keeping, and under his own seal
Ingeram (party D): you have forbidden him who has them to deliver them to us
Howard JCP: you are sufficiently in possession of them, since they are under your seal, and if she forbad him to eat (manger), what of that?
Sjt Hedon (for D) was stopped by Bereford JCP because he began again to plead thereon (end of angry exchange reopening a judgment) |
