Novae Narrationes C113, 80 SS 206, was identified by Shanks as the count in this case, headed 'Bridge to be pulled down' (De ponte prosternando', and identified the plaintiff as Thomas Hay and the defendant as the Prior of Barnwell (Bernewille, omitted in most MSS), that defendant wrongfully did not permit plaintiff to pull down a bridge (pont) in
B., which predecessor prior John wrongfully and without judgment erected to the detriment (a la nusance) of the freehold of William Hay, father of plaintiff Thomas, whose heir he was, in M. since the first crossing, etc.; wrongfully because whereas a stream runs between the vill of M. and the vill of B., which vills do not intercommon (ne sentrecomunent), and now animals cross (trespassent) the stream in both directions, and so there has to be a hayward (vn messer) where before there was no need for a hayward (messer); and by the pillars (les pilers) and posts (lestaches or lostages or estages or lez Stakes) of the bridge (pount) water (leawe) is so held bak that it floods (surunde) an acre of meadow (pree) that formerly belonged to William in M. and now belongs to plaintiff Thomas |
