it was said that a continuance by Capias ought to be made from Term to Term, and cannot be made over an intervening Term ('nul terme meane'), and this is done because the defendant cannot remain so long in prison, etc. but by Distraint a continuance could be made beyond an intervening Term (un terme meane as from Mich. Term to Pasch.
