Defendant pleaded that he was parson, that the grain was severed, and that defendant parson took them as tithes.
Newton CJCP told defendant to answer to the grazing and not to carrying off grain, because the action did not suppose that.
Defendant pleaded that he was parson, that part of the grain was tithes and part not, and that defendant came to carry off his tithes and could not avoid coming onto plaintiff's grain, which was the same grazing.
Newton CJCP told defendant that he could not plead this but could plead that plaintiff sowed the grain after plaintiff had carried off his grain and (before) defendant could come onto the land to carry off his tithes, which was the same grazing and trampling. |

| Newton CJCP: you ought to answer to the grazing (puer) and not to the carrying off (enporte), because the action does not suppose (that defendant carried off grain); you cannot come onto (pur) the plaintiff's grain to carry off your tithes, but your tithes remain (demurre) until the grain be carried off, but you can say that you came to carry off your tithes and the grain was sown semes on the land after which the plaintiff had carried off his grain and you came onto the grain which was the same grazing (puer) and trampling (conculcac, Latin) |
