Process and Pleading
Scire facias was sent to the coroners.
It was returned by one of the coroners.
Defendant(?) pleaded that the Scire facias ought to be returned by all the coroners' names, and prayed that the coroners be amerced.
Fortescue CJKB argued that there might be no default if the writ never came to more than one coroner.
Sjt Portyngton argued that all of the coroners would be amerced because he who returned the writ ought to return it is all their names.
Fortescue CJKB argued that there might be only one coroner in the county, then told plaintiff to sue Scire facias sicut alias because this writ had not been served, and said that the Court would be advised as to amercement.

Abstract Context
Commentary & Paraphrase
Fortescue CJKB: there is no default unless in him who returned the writ, because it could be that the writ never came to the other (coroners)
Sjt Portyngton: all will be amerced because he who returned the writ ought to return this in all their names
Fortescue CJKB: it seems so to me, and if the return had been 'J.B., coroner', the return would have been good, because it could be that there was only one coroner within the same county, so sue
