Process and Pleading
Defendant pleaded that plaintiff Herle entered into religious profession as a canon.
Plaintiff replied that by the deed defendant was obliged to plaintiff Herle as vicar, by which defendant accepted that he was a secular person.
Cokayn JCP told plaintiff to reply again.
Plaintiff replied that defendant had not alleged whether plaintiff professed before or after making the deed.
The opinion of the Court was that defendant's plea was good.
Plaintiffs asked defendant what he pleaded against the other plaintiffs.
Defendant made defence (pleaded not guilty) and demanded hearing of the writ.
The writ was read.
Defendant pleaded that the writ named the other plainitffs 'yeomen' and the obligation did not.
The Court asked the clerk what the obligation stated.
The clerk said that it was as defendant rehearsed.
Cokayn JCP told plaintiff he would take nothing by his writ.
Then the clerk read the obligation again, and said that it was worded differently.
This was shown to plaintiffs' counsel.
The Justices read the obligation, and found it thus.
They adjudged that defendant should answer to plaintiffs.
Defendant pleaded as before that plaintiff Herle was professed, and the other plaintiffs joined with one not able to sue, so the writ should abate.
Plaintiff Herle replied that he was vicar by presentment of the religious house to a perpetual vicarage, not under obedience.
Plaintiff amended his reply to add that vicars of C. had impleaded and been impleaded, and that plaintiff Herle was presented before the statute of 1402.

Martin JCP: If I make an obligation to my wife by a strange name, if she brings a writ of Debt against me on the deed, will I be received to say that she is my wife? (rhetorical question, obviously yes)
Sjt Rolf: Sir, if I grant land to a monk by fine by the name of a secular person, will I be received in a Scire facias to say that he is professed? I say no.
Babington CJCP distinguished monks and married women on the grounds that a monk is a person dead in law, and cannot have advantage, while a wife can have advantage; if a monk purchase certain land with another secular person, I say that all the purchase is in the secular person, and if a monk purchase solely, I say that the purchase is void
Martin JCP: For surplusage on the part of the defendant the writ will not abate, but on the part of the plaintiff it is otherwise, for it must agree with the deed or record
The clerk at first said that the obligation was as defendant alleged. Cokayn JCP then told plaintiff to take nothing by his writ. Then the clerk said that the obligation was not as defendant said, and showed it to plaintiff's counsel. The Justices read the obligation. They adjudged that defendant answer. Defendant said he had already received judgment. Babington CJCP said that all was one day.
Plaintiff Herle: the church of C. was the advowson of the House of A., which has since time immemorial presented one of its canons to be vicar
Arguments about obedience, profession, and disability of professed clergy. A monk who as vicar no longer owed obedience to the Abbot was not by that fact made able to sue for debts. All references to the Pope were to 'supreme head of the church'. Only the Pope could nullify profession, but the Archbishop, with license of the Abbot (sovereign) could nullify obedience. Distinction between spiritual things, as to which a professed monk could be made able, and temporal things, as to which a professed monk could not be made able. Serjeants and Justices showed knowledge of canon law at it operated on the clergy.
in 1484.047 = Mich. 2 Ric. 3, pl. 47, fol. 18b-20a, at fols. 19b-20a, Sjt Townshend said that Mordaunt said that an action (was) brought against a vicar of a church, the defendant said that 'he is a monk professed' under the obedience of a (sovereign, superior), etc. and showed the certainty, now it is a good reply, to plead 'he is perpetual', and that he and his predecessors vicars, etc. from time immemorial etc. had been pleadables and had impleaded others, etc. without naming the sovereign

Statham Addicion 1 dated this Trin. and stated: it is a good addition, 'Praecipe such a one of the county, yeoman' without naming his vill, and it was said in the same plea, that if one be bound by the name J. of B., of B. in the county of B., it is no plea to say, 'no such vill as F. within the same county', because he is bound by such a name.
Statham Nonnabilite 2, a long entry, dated this Mich., identified the plaintiff as A., vicar of B., and defendant as F., attributed a speech for plaintiff to Sjt Paston, and stated that the Abbot of S. presented, and Babington CJCP mentioned the statute of 4 Hen. 4 (1402), ch. 12
Fitzherbert Nonhabilite 1 dated this Mich. 3 Hen. 6, fol. 23, identified the plaintiff as A., vicar of B., and the defendant as F., and an abbot of S. who presented the vicar.
Fitzherbert Dett 14, a long entry, identified the plaintiff as T. herle, vicar of D, and Sjt Paston distinguished what the Pope and a sovereign (of a religious house) could do.
