Defendant parson pleaded that he found his church discharged, and prayed aid of the patron and ordinary.
Plaintiff replied that the debt charged the person, not the church.
Defendant demanded judgment and prayed the aid.
Plaintiff objected that defendant could not have the aid in a writ of Debt.
By advice of all the Justices, Cokayn JCP granted defendant the aid.
At another day, plaintiff said there was doubt to which sheriff process should be sent to summon the patron and ordinary. |

Statham Annuite 5 queried whether the action lay, any more than for arrears of rent service, and added: see the Register (Registrum), for it seems that this action for debt for the arrears of an annuity does not lie, except where the annuity is recovered, and for those arrears the action lies and not for the arrears accrued after the recovery, and the plaintiff should declare upon the recovery
Statham Aide 38 identified the plaintiff as J.G., the testator's church as D., defendant's church as F., attributed defendant's plea to Sjt Rolf, and added: and query, if that action lay for the executor; because it seems that he will nothave the arrears of an annuity, when the annuity is granted in fee, no more than executors would have arrears of a rent service, etc.; but yet some say that executors will have an action for rent service accruing in the lifetime of their testator, because otherwise no one would have it. |
