This course will examine the framework of constitutional, statutory, and international law, which variously both authorize and constrain the U.S. government’s conduct of national security policy at home and abroad. We will cover, in particular, (i) the respective powers of each branch of the federal government in the realm of national security law; (ii) the use of military force; (iii) counter-terrorism policies and controversies (military tribunals, the detention and trial of “enemy combatants,” extraordinary rendition, etc.); and (iv) counter-intelligence, surveillance, and covert action.
