{"id":101598,"date":"2016-09-23T17:22:39","date_gmt":"2016-09-23T21:22:39","guid":{"rendered":"http:\/\/www.bu.edu\/tech\/?page_id=101598"},"modified":"2024-08-27T10:38:34","modified_gmt":"2024-08-27T14:38:34","slug":"copyright-violation-policy","status":"publish","type":"page","link":"https:\/\/www.bu.edu\/tech\/services\/security\/cyber-security\/dmca\/copyright\/copyright-violation-policy\/","title":{"rendered":"Copyright Violation Process"},"content":{"rendered":"<h2>BU\u2019s Copyright Violation Notification Process<\/h2>\n<p><b>Illegal File Sharing<\/b><\/p>\n<h3><a href=\"https:\/\/www.bu.edu\/dos\/annual-notice-concerning-peer-to-peer-file-sharing\/\">An Important Message from the Dean of Students<\/a><\/h3>\n<p>It is illegal and a violation of Boston University policy to download or upload copyrighted materials unless you have permission from the copyright holder or one of the <i>limited<\/i> exceptions under the U.S. Copyright Act applies (e.g., <a href=\"https:\/\/www.bu.edu\/tech\/security\/incidents\/copyright\/basics\/\">fair use<\/a>). It is copyright infringement.<\/p>\n<p><b><i>How can I tell whether what I\u2019m sharing is copyrighted material?<\/i><\/b><\/p>\n<p>It used to be that copyrighted work had to have the copyright symbol (<b>\u00a9<\/b>)<br \/>\nprominently placed on the work. The law has changed. Now, original work is copyrighted <i>as soon as<\/i> it is in tangible form \u2014 the copyright holder doesn\u2019t have to register anywhere and no \u00a9 is necessary.<\/p>\n<p>It is not easy to tell whether a copyright has expired either. Without a lot of<br \/>\nresearch, the only materials you can be sure are out of copyright are works<br \/>\npublished in the United States before January 1, 1923 and works published by the U.S. federal government and some state governments (including<br \/>\nMassachusetts).<\/p>\n<p><b><i>Violations of Federal Copyright Law<\/i><\/b><\/p>\n<p>You could face both civil and criminal penalties for copyright infringement.<\/p>\n<ul>\n<li>Civil penalties could be between $750 and $150,000 per work for willful infringement. In other words, if you download 3 songs illegally, the civil penalty could be as much as $450,000.<\/li>\n<li>Criminal penalties for willful infringement range from fines to 10 years in prison.<\/li>\n<\/ul>\n<p><b>It is no defense that&#8230;<\/b><\/p>\n<ul>\n<li>You only listened to the songs or watched the movies in your room<\/li>\n<li>You never made more copies<\/li>\n<li>You didn\u2019t know it was copyrighted<\/li>\n<li>You didn\u2019t know the law<\/li>\n<\/ul>\n<p><b>&#8230;and in most cases, you may not rely on the Fair Use doctrine will either.<\/b><\/p>\n<p><b><i>Violations of University Policy<\/i><\/b><\/p>\n<p>Illegal file-sharing is a violation of BU\u2019s Conditions of Use and Policies on Computing Ethics and the Code of Student Responsibilities. The University regularly receives notice of allegations that students have shared files illegally.<\/p>\n<p>For a 1st offense:<\/p>\n<p>Violators will be required to participate in an educational program about copyright and certify that infringing materials have been removed from their computers.\u00a0 Failure to complete those tasks within one week of notification, will result in suspension of the BU Kerberos account.<\/p>\n<p>For a 2nd offense:<\/p>\n<p>Violators will receive a letter from the Dean of Students, be required to participate in a second educational program, and again certify that infringing materials have been removed from their computers. Failure to complete those tasks within one week of notification, will result in suspension of the BU Kerberos account.<\/p>\n<p>For a 3rd offense:<\/p>\n<p>You will be referred to the Office of Judicial Affairs, which has the authority to impose the full range of sanctions, including fines, suspension, and expulsion.<\/p>\n<p><b><i>To avoid illegal sharing\u2026<\/i><\/b><\/p>\n<p>1)\u00a0\u00a0\u00a0\u00a0\u00a0 <span style=\"text-decoration: underline;\">Check your computer<\/span> for software that automatically uploads files<\/p>\n<p>2)\u00a0\u00a0\u00a0\u00a0\u00a0 <span style=\"text-decoration: underline;\">Avoid sources of illegal media online<\/span>. There are countless sources of illegal media online\u2014too many to name here.
