How can I tell whether what I\u2019m sharing is copyrighted material?<\/h3>
<\/strong><\/p>\n

It used to be that copyrighted work had to have the copyright symbol (\u00a9)
\nprominently placed on the work. The law has changed. Now, original work is copyrighted\u00a0<\/span>as soon as<\/em>\u00a0<\/span>it is in tangible form \u2014 the copyright holder doesn\u2019t have to register anywhere and no \u00a9 is necessary.<\/p>\n

It is not easy to tell whether a copyright has expired either. Without a lot of
\nresearch, the only materials you can be sure are out of copyright are works
\npublished in the United States before January 1, 1923 and works published by the U.S. federal government and some state governments (including
\nMassachusetts).<\/p>\n

It is no defense that\u2026<\/p>\n

You only listened to the songs or watched the movies in your room<\/p>\n

You never made more copies<\/p>\n

You didn\u2019t know it was copyrighted<\/p>\n

You didn\u2019t know the law<\/p>\n

\u2026and in most cases, you may not rely on the Fair Use doctrine will either.
\n<\/div>\n<\/div>\n<\/span><\/p>\n

How Are Violations of University Policy Handled?<\/h3>
<\/strong><\/p>\n

Illegal file-sharing is a violation of BU\u2019s Conditions of Use and Policies on Computing Ethics and the Code of Student Responsibilities. The University regularly receives notice of allegations that students have shared files illegally.<\/p>\n

For a 1st offense:<\/p>\n

Violators will be required to participate in an educational program about copyright and certify that infringing materials have been removed from their computers.\u00a0 Failure to complete those tasks within one week of notification, will result in suspension of the BU Kerberos account.<\/p>\n

For a 2nd offense:<\/p>\n

Violators will receive a letter from the Dean of Students, be required to participate in a second educational program, and again certify that infringing materials have been removed from their computers. Failure to complete those tasks within one week of notification, will result in suspension of the BU Kerberos account.<\/p>\n

For a 3rd offense:<\/p>\n

You will be referred to the Office of Judicial Affairs, which has the authority to impose the full range of sanctions, including fines, suspension, and expulsion.<\/p>\n

How Can I Avoid Illegal Sharing?<\/h3>
<\/strong><\/p>\n

1)\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0Check your computer<\/span>\u00a0for software that automatically uploads files<\/p>\n

2)\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0Avoid sources of illegal media online<\/span>. There are countless sources of illegal media online\u2014too many to name here. They fall into a few basic categories<\/p>\n

P2P (peer-to-peer) software<\/p>\n

Torrents<\/p>\n

Browser-based downloads<\/p>\n

Regardless of the source, if you distribute copyrighted works without permission from the copyright owner, it is a violation of law and Boston University policy<\/p>\n

3)\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0Use legal alternatives<\/span>, such as:<\/p>\n

Free Streaming music:<\/p>\n

Services like Pandora, Slicker, Last.FM and Rhapsody allow you to stream music for free.<\/p>\n

Cheap Music Downloads:<\/p>\n

Use services like Amazon Music Store or iTunes to buy music for as little as 99 cents.<\/p>\n

Free Streaming Movies and TV:<\/p>\n

Free content is available at major sites like Hulu and YouTube and smaller sites like Joost, Babelgum, and Atom Films.<\/p>\n

Cheap Movies and TV Shows:<\/p>\n

Stream individual movies or shows with Amazon, iTunes, or BestBuy\u2019s Cinema, or get unlimited streaming with HuluPlus or Netflix.<\/p>\n

DVDs:<\/p>\n

Borrow, purchase or rent DVDs from the BU or public library, Redbox or a video store.<\/p>\n

How will I know if I have a pending copyright violation?<\/strong> <\/h3>
<\/strong><\/p>\n

Copyright violation infringement notices are sent to\u00a0your BU email account detailing the incident and infringing material\/file. Upon receiving the initial notice, you have 7 days to take action and comply electronically (action and instructions on how to rectify the violation are detailed within the email notification<\/em>).\u00a0For more information regarding copyright notices visit this\u00a0<\/em>link<\/em><\/a><\/p>\n

How do I know if something is copyrighted?<\/h3>
<\/strong>
\nWhen you buy music legally, there is usually a copyright mark somewhere on the product. Stolen music generally doesn\u2019t bear a copyright mark or warning. Either way, the copyright law still applies. A copyrighted creative work does not have to be marked as such to be protected by law.<\/p>\n

If I bought the CD, is it okay to make copies of it?<\/h3>
<\/strong>
\nIt is illegal to copy a CD for use by someone other than the original purchaser. This means it is illegal to loan a friend a CD for them to copy, and it is illegal for you to make mixed CDs and distribute them to your friends as well.<\/p>\n

What if I upload or download music to or from a server that is based outside of the U.S.?<\/h3>
<\/strong>
\nIf you are in the United States, U.S. law applies to you regardless of where the server may be located.<\/p>\n

Will I be responsible for the DMCA copyright violation if someone else commits the violation using my account?<\/strong> <\/h3>

Yes, you are responsible for any activity that occurs using your account<\/p>\n

How do I know what is legal and what is not when it comes to copying music?<\/h3>

\nHere is the bottom line: If you distribute copyrighted music without authorization from the copyright owner, you are breaking the law. Distribution can mean anything from \u201csharing\u201d music files on the Internet to burning multiple copies of copyrighted music onto blank CD-Rs.<\/p>\n

Is it illegal to upload music onto the Internet even if I don\u2019t charge for it?<\/h3>
<\/strong>
\nYes, if the music is protected by copyright and you do not have the copyright holder\u2019s permission. U.S. copyright law prohibits the unauthorized distribution of copyrighted creative work whether or not you charge money for it.<\/p>\n

If all I do is download music files, am I still breaking the law?<\/h3>
<\/strong>
\nYes, if the person or network you are downloading from does not have the copyright holder\u2019s permission. Peer-to-peer systems like KaZaa, Grokster, Gnutella, LimeWire, Morpheus, WinMX, Aimster, and Bearshare have music that is not legal for you to download.<\/p>\n

What if I download or upload poor-quality recordings?<\/h3>

\nThe law prohibits unauthorized copying and\/or distribution of digital recordings that are recognizable copies of copyrighted work. The quality of the recordings does not matter.<\/p>\n
