Commentary & Paraphrase
Editors: A writ of quare impedit brought by the King was abated because the defendant proved that he and three of his predecessors had presented to the living.
Headnote (I): Quare impedit where the writ was abated for the reason of a last presentation because it is a writ of possession.
Headnote (II): Quare impedit for the King abated by a later presentation.
Headnote (III): Quare impedit for the King abated as aforesaid.
Noted at 54 SS xxx-xxxi.
Scrop Sjt: no right can outweigh the right of his crown against our lord the King, for it is always within age and cannot lose in court (nul dreit sur dreit de sa Coroune ne pust a nostre seignur le Roi qe touz jurs est deinz age et ne put perdre en curt). (Notwithstanding this, the King took nothing by his writ).
Scrop Sjt (version II): the King is always within age, so that no time runs against him in maintaining the estate of his crown (le Roy est touz jours deinz age issint qe encountre ly nul temps ne court quaunt a maintener l'estat de sa Coroune).
A John of Nassington, parson of the church of F., was defendant in 1331.099 = Trin. 5 Edw. 3, pl. 31, fols. 28b-29a (debt).
