Bolland: The issue in this action of replevin was whether a deed made by an ancestor of the defendant had been made within or before the time of memory.
Headnote: In a writ of replevin the defendant avowed for suit and the plaintiff tendered a deed of the defendant's ancestor in rebuttal etc. and the defendant was made to answer this deed; and he afterwards said that he and his ancestors had been continuously seised since a time before memory. Afterwards the parties joined issue on the question whether the deed was made within or before the time of memory. |
