Bolland: This was an action to recover several bonds securing the payment of moneys by several debtors to the plaintiff. The plaintiff's case was that these bonds had been bailed to the defendant upon the condition that he should return them to the plaintiff at his request. The defendant, on the other hand, said that they had been given to him for the purpose of collecting the moneys secured by them. But he did not say that he had collected such moneys. Being forced to say whether he had or not, he allowed that he had received the moneys secured by them except in one instance, and that he was willing to return that one bond. The Court ordered him to return it, and the plaintiff was left to recover, by an action of account, the moneys received on the other bonds.
Headnote: In a writ of detinue of writings the defendant said that he did not receive them to return to the bailor but to hand them to divers debtors and to receive themoneys etc. But afterwards he was made to say whether he had actually received the moneys etc., and then he said that he had received part of them. And some thought that he ought to be called upon for an account.
