Commentary & Paraphrase
Brand: In Novel disseisin the defendants claimed to have entered through a judgment of the king's court on a default after appearance by a previous master. The plaintiff denied that the judgment ought to prejudice him because the master named had not then been head of the house. The assize confirmed that at the time of the judgment the master now suing was head of the house, not the master named as tenant in the previous suit. Judgment was therefore given for the plaintiff.
