Brand: John son of John Acer of Wilton died in possession of lands but without issue. His great-uncle (or, more plausibly, as the record indicates, the grandson of his paternal grandfather's brother) claimed the land in an action of Cosinage as his closest surviving relative. The tenant of the land, who was a minor, claimed to have entered the land himself as his closest heir and asked for the suit to be deferred till he came of age. The claimant objected that he was a stranger and the court required him to trace his relationship to the deceased. He claimed that the land had been acquired by Beatrice, the mother of the deceased tenant, and that he was the next of kin as the son of her brother, John Maunsel. The claimant denied that this was so and said the first purchaser of the land had been Beringer, the uncle of the dead tenant, and the land should therefore pass to his collateral kin. Despite the minority of the tenant the court ordered a jury trial which confirmed that Beringer and not Beatrice had been the first purchaser. Judgment was therefore given for the claimant.
