Brand: In an action of Precie quia dominum inde remisit curiam the tenant was not allowed to take issue on whether all (or any part) of the land being claimed was held of a lord other than the lord of whom the demandant claimed to hold and who had waived his court. The tenant then pleaded in bar a concord made between his father and the demandant's father under which the latter renounced all claim to the lands concerned. This concord had been enrolled on the plea-rolls of the king's court and a note of its terms had been filed but no chirography based on its terms had ever been drawn up. When the enrolment was found, the demandant denied that it barred him from action as the proper procedures for the making of a peace in the king's court had not been followed. The enrolment of the case indicates that the tenant was forced to choose between reliance on the enrolment and the filed note and chose the former and also explains more clearly the grounds for the demandant's plea that the peace had been improperly made and thus was not binding. The case was eventually settled by a further concord between the parties.
