Brand: Isabel held lands in Grendon and in Panton by the endowment of James. She subsequently surrendered all her dower lands in Panton to the warrantor of her dower in return for additional lands in Grendon, also formerly held by James, and a cash payment. The claimants then brought a writ of Entry sur disseisin against Isabel claiming some of the additional lands in Grendon and asserting that her title to these lands came from a grant made by the warrantor, whose own title derived from James, the alleged disseisor. Isabel asked for judgment of the writ on the grounds that the lands were her dower and so her title was derived from James and not from the warrantor. The claimants then recounted the details of the exchange and alleged that this meant that her title derived from the warrantor and not James. The court held that land given in exchange for dower was the same in law as land assigned in dower and so her title to the land was derived from James and thus the writ was defective.
