Plaintiff sued an Appeal of Mayhem against defendants, and counted that defendants on a certain day and year had maimed plaintif feloniously, so that plaintiff counted 'feloniously'.
One of the defendants prayed that it could be viewed by the Court whether plaintiff was maimed or not.
Tremayle JKB, who was in King's Bench, and no other Justices except himself, said that it would be peremptory for the defendant if the plaintiff were to be adjudged (by the Court) maimed, because the Court did not 'ex officio' have to view the mayhem (maiming).
Tremayle JKB said to the one defendant who pleded this matter, that this defendant would imparl (?) (serra ent-), and that Tremayle JKB wanted to be advised until Fairfax JKB came into Court.
Defendants, by an apprentice, did not dare to plead thus (to pray a view of plaintiff's maiming by the Court) but pleaded a concord (settlement, compromise) between plaintiff and defendant for this and all maimings and trespasses from the beginning of the world until such a day since the day of the supposed maiming at Dale in such a county, and that defendant would pay to plantiff 40 shillings, which defendant had there.
Then defendant paid plaintiff.
Plaintiff received the 40 shillings (part of defendant's plea? or actual payment in Court?).
Defendant had been committed to custody, and could not be left (pris) to bail because evidence was given of (defendant's) heinous fault and abominable maiming, because plaintiff's leg bones (tibies) had been broken on the threshold of a house, and plaintiff's bones where shown to the Court. |

Reporter (R.): so see the opinion of Tremayle JKB that the view (by the Court of the maimed plaintiff) is peremptory for the defendant, if it be adjudged a maiming (mayhem), because he (defendant) cannot then plead 'not guilty', nor another bar, because if it be not mayhem, he can plead 'not guilty', and he (defendant) will be found not guilty; but query; because in Gray's Inn it seemed to all that it (praying for the view) is not peremptory; and so see that the defendant was committed to custody (garde), and cannot be left to bail because evidence was given of the heinous fault and abominable (nature of) the maiming: because his leg bones (tibies) were broken (infreints) on a threshold of a house, and the bones (les os) were shown to the Court (compound fractures, bones showing), so he could not be left (pris) to bail in this Appeal of Mayhem, no more than in an Appeal of Murder, or of Robbery; which note, because the act (fait) was so mischievous, as the evidence was given |
