Sjt Herle (for D); it is a common phrase in this Court to say that the fine is recorded when engrossed, and not otherwise; yet John has a bad case because the Court ought not to maintain or suffer it
Staunton JCP: we now all about the case before you
Mallore JCP: We find that the fine that was levied was not accordant with the note, where fore the fine was not warranted by the note; and because we find such an error in that process we annul it entirely, aned you may sue out another writ on the footing of the first note (hors de la primer note), if you please, &c.
