Commentary & Paraphrase
where the plaintiff had no deed to show the annuity
demand for 12 marks (= 8 pounds) as arrears of an annuity of 6 marks (= 4 pounds)
Sjt Herle (for D): they do not show any legal specialty or contract, such as a grant by the patron with the asent of the bishop witnessing the thing that they demand, and for anything that they have shown in their count it is a pension and a spiritual thing turned into a temporal thing, and we pray judgment if this Court ought to take cognisance of the plea; the statute of Circumspecte agatis ((1285), 13 Edw. 1, stat. 4) applies in that case, it is a pension, and pleadable in the court Christian
Sjt Toutheby (for P): he is seised as in right of our church of a spiritual thing; the assent of the bishop does not make it a temporal thing nor an annuity; if we were to implead him in Court Christian, and the Prohibition were brought, we should not have the Consultation on the demand for this annuity; nevertheless neither the assent of the bishop nor of the parson &c. makes such a thing a lay matter (chose laye); the estates of these persons, namely the bishop and the parson, are spiritual, and the estate of the patron, namely the patronage, although the patron be a man of holy churh, is a temporal thing
Howard JCP: in past times (auxien temps) one could give one's tithes when one thought fit, and it appears that since the patron by whom the church was first endowed reserved the six marks to his patronage as in right of his patronage, it is sufficiently a temporal thing
