Process and Pleading
Defendant pleaded that the obligation was endorsed with such a condition, that if defendant would keep (gardera) the covenants comprised in a certain indenture that the obligation would be void, and defendant showed that plaintiff leased his parsonage to defendant with the appurtenances, that defendant entered and had the meadows and willow trees at midsummer, that defendant should repair the parsonage during the term, that various conditions were in the affirmative and in the negative, that defendant would not make nor carry off various things specified in the indenture, that as to all the covenants in the affirmative defendant had performed them, and that as to the conditions in the negative that defendant did not do them.
Plaintiff replied (?) that defendant had not shown how many willow trees (salowes) defendant had, and that defendant ought to have expressed the quantity, because an issue would come of this.
Choke JCP and Bryan CJCP agreed.
Defendant rejoined (?) that defendant did not need to show how many.
The Justices disagreed and told defendant to plead both pleas (either plea?) at his peril.
