The attorney of the Duchy of Lancaster asked whether the feoffee of lands granted by the king in right of his Duchy of Lancaster ought to have livery of seisin. |
queux il ad en droit de son Duchy de Lancaster en fee, ou a terme de vie, que il covient aver livere de seisin, sibien come si feoffement soit fait per auter comen person, s' il ne soit des terres deins le County Palatine, queux passa per les lettrez patent del Duchy sans livery, mes leas fait pur terme d' ans d' eux ou d' auters terres covient estre fait per fait, quod nota
Et cest question fuit demande per l' Attorney del Duchy |
all the Justices: if the king made feoffment of lands which he had in right of his Duchy of Lancaster in fee, or for a term of life, that he ought to have livery of seisin, as well as if a feoffment be made by another common person, if it be not for lands within the County Palatine, which pass by the letters patent of the Duchy without livery, but a lease made for term of years for them or for other lands ought to be made by deed,
