Defendant pleaded by showing that plaintiff held (aver) the land of defendant in execution by a statute merchant, and that defendant had come to and entered into the land to see if any waste had been committed.
Plantiff replied that defendant committed the trespass 'as above' by his own wrong, without such cause.
Littleton JCP said that this was no issue, because defendant had justified the entry to see the waste, and if the issue would be taken the intent of defendant would be put on trial, which could not be.
Bryan CJCP said that the issue was not good was because defendant took up defendant's own authority to enter (plaintiff's land).
Further discussion.
Then plaintiff waived the issue that plaintiff took before and replied that defendant entered in the land and claimed the land as defendant's own land, denying that defendant came to see the waste.
Littleton JCP said that there was no need for plaintiff to plead the denial (sans ceo).
Plaintiff said that the reply was no worse for the denial (sans ceo).
Sjt Pygot said that plaintiff did not need to take the denial (sans ceo). |
Littleton JCP: Ceo n' est issue, car icy il ad justifie l' entre pur veier le wast, &c.; Et si l' issue 'ut supra' serra pris l' entent de luy serra mise en trial, le quel en poit estre
Bryan CJCP: L' entent de home serra trie en robberie & en recaption, mes le cause que l' issue est bon est pur ceo que le defendant preigne aucthoritie de luy mesme d' entre, &c. covient d' estre respondue, come si home justifie en son entre en un Tavern pur boier, le plaintiff ne dirra de son tort demesne, &c. car il preigne aucthority de nulluy, forsque de luy meme, &c. Mes si home justifie come servant a un auter, la de son tort demesne, &c. est bon issue, & si home justifie per aucthority del plaintiff mesme, come per licence, ou per leas, le plaintiff ne dirra que il enter de son tort demesne sans tiel cause, &c.
Sjt Catesby (for P): La il conclude le plaintiff per son act demesne, &c. mes auter est icy, & si un justifie l' emprisonment d' un per suspeccion de felony, &c. le plaintiff dirra de son tort demesne, &c. et uncore il ne prist aucthoritie de nul auter
Bryan CJCP: en vostre case il justifie per un tort fait al estranger, &c.
Choke JCP: Lou home justifie per matter en fait, come pur rent arrere, le plaintiff poit dire de son tort demesne, &c. sinon que il justifie per licence ou commandment del plaintiff, mes icy le briefe est port sur matter de recorde, de que le pays (= jury) ne poit aver notice, &c.
Bryan CJCP: Cest voier, car en Assise si le plaintiff fait title parcel sur matter de record, et parcel sur matter en fait, le tenant ne dire veignes l' Assise sur le title, &c.
Et puis Sjt Catesby (for P) waiva l' issue que il prist devant, et disoit que il entre en le dit terre et cliama le dit terre come son terre demesne, &c. sans ceo que il venoit de veier le wast
Littleton JCP: Il ne besoigne adire sans ceo, mes suffist adire que il claima le terre estre son terre demesne sicome il voile dirray que il disseisist le plaintiff et il reenter, sur que il ad conceive cest accion, et si home justifie son entre en tavern pur boier, &c. et le plaintiff monstre que il prist un peece (= pece, drinking cup OED, perhaps chalice) ou fist auter tort, il ne besoigne de prendre sans ceo

Littleton JCP: this is no issue, because here he (defendant) has justified the entry to see the waste, etc.; and if the issue 'as above' wll be taken, his (defendant's) intent will be put on trial, which cannot be (no trial of mental states, only God can know one's intent)
Bryan CJCP: one's intent will be tried in robbery and in retaking (recaption), but the reason (cause) why the issue is good is because the defendant's taking of (preigne) authority on himself to enter, etc. ought to be answered, as if one justify his entry into a tavern to drink (boier), the plaintiff will not reply 'of his own wrong' (de son tort demesne), etc. because he (defendant) took authority from no one but from himself, etc.; but if one justify as servant of another, there 'of his own wrong' etc. is a good issue, and if one (defendant) justifies by authority of the plaintiff himself, as by license or by lease, the plaintiff will not reply that he (defendant) entered 'of his own wrong without such cause', etc.
Sjt Catesby (for P): there (plea of plaintiff's lease or license) he (defendant) precludes (conclude, estops) the plaintiff by his own act, etc. but it is otherwise here, and if one justifies the imprisonment of another by suspicion of felony, etc., the plaintiff will reply 'of his own wrong', etc. and yet he (defendant) did not take authority from anyone else
Bryan CJCP: in your case he (defendant) justifies by a wrong done (a felony committed by plaintiff) to a stranger, etc.
Choke JCP: where one justifies by a matter in fact, as for rent in arrears, the plaintiff can reply 'of his own wrong', etc. unless he (defendant) justified by license or plaintiff's command, but here the writ is brought on matter of record, of which the jury (le pays) cannot have notice
Bryan CJCP: this is true, becaus ein an Assize if the plaintiff makes title partly on a matter of record and partly on a matter in fact, the tenant (defendant) will not say 'bring the Assize (jury) on the title,etc.
and then Sjt Catesby (for P) waived the issue that he took before, and said that he (defendant) entered on the said land and claimed the said land as his own land, etc., denying that he (defendant) came to see the waste
Littleton JCP: there is no need to plead the denial (sans ceo), but it suffices to reply (adire) that he (defendant) claimed the land to be his own land, as if he wanted to plead (dirray) that he (defendant) disseised the plaintiff, and he (plaintiff) re-entered, on which he had conceived this action, and if one (defendant) justifies his entry into a tavern to drink (boier), etc., and the plaintiff shows that he took a drinking cup (peece) or committed another wrong (tort), there is no need to take a sans ceo (denying that defendant entered to drink)
Sjt Catesby (for D): it (plaintiff's reply) is not the worse (le peior) for the denial (sans ceo)
Sjt Pygot: if one justifies taking of animals for rent in arrears, (and) the plaintiff replies (dit) that he (defendant) took and put the distraint (plaintiff's animals) to his own use (oeps), or killed (occide) them, etc. there is no need to take a denial (sans ceo)
