Nedeham JCP, Littleton JCP, and Moyle JCP: if I release to a prior 'all actions that I have against the same (prior) and his convent' this word 'convent' (covent) is void, because against a covent one will never have an action, so it will be understood, 'all actions that I have against the prior', as if I release all actions that I have against him and a dead man (monks were dead in law), etc.;
and also they (Nedeham JCP, Littleton JCP, and Moyle JCP) said that if I release to B. all actions that I have against him and C. by this deed all actions that I have against B. solely and jointly are extinct (extients), etc. but it is otherwise if it (the release) says 'all actions that I have (against B. and C.) together (conjunctim)', this only extends to joint actions
Moyle JCP said that if I release all actions to him, etc. this is good without saying 'that I have against B.', etc., because this is only the scrivener's form (scribe's form);
and where a female executor (executrix) marries (prent baron) and (her) husband releases, this will bar during the marriage (coverture) without question, by the Justices,
but if he will be barred after the marriage (coverture), this is true (a vier) (?), by Choke JCP
but Sjt Pygot said that once extinct, always extinct, etc. |
