Plaintiff brought his action on the Case that where plaintiff was lord of a manor, and that plaintiff and his ancestors tenants of the same manor had been acquitted of tithes from the same manor from time immemorial, that certain land had been given to one of defendant's predecessors, that defendant had drawn plaintiff into a plea in Court Christian for tithes from this same manor, on which matter plaintiff rehearsed that the defendant still continued his process in Court Christian, and plaintiff prayed a prohibition.
Defendant (?) replied that one would not have prohibition unless he was impleaded in Court Christian for a thing that would be determined in this Court, and here this matter was a right to tithes. |

Sjt Nele (for D?): one will only have a prohibition where he is impleaded in Court Christian for a thing that will be determined in this Court, and here this matter which is sued in Court Christian cannot be determined (here because) this is a right to tithes (de jure decimarum)
Sjt Catesby (for P?): I deny your principal case, because if one be indebted to me for 20 pounds and makes his executors, and I sue them (executors) in Court Christian, they will have a Prohibition, and yet on this debt (duity) I will never have an action here, because this was on a simple contract, etc.
Littleton JCP: if it be as the plaintiff had said, the defendant has done wrong to him to sue in Court Christian, and by this action he cannot recover damages except for the previous time (temps avant), etc. then it will be reasonable that pending this suit that he will have a prohibition, and if it be found for (ove) the defendant then to grant Consultation, as where a parson impleads another parson for certain tithes that amount to one fourth part of the Church, and the patron (?) (prove) of the defendant clerk brings a writ of Right for the tithes, he (defendant clerk's patron?) will have Indicavit to make the judges in Court Christian stay (surcesse) until it (the writ of Right) be determined here, and a Consultation will be granted when the matter is determined here, etc., so here

Sjt Jenney: when one is impleaded in Court Christian for a thing that can be determined here, then Prohibition lies, as in the case that my master Littleton JCP (has put) when he impleaded the parson for tithes, if it be found for (ove) the plaintiff, the advowson of this party is recovered, in a way (la en maner), and the right of the advowson can be determined here, but if I and another are made executors, and I grant to my companion (fellow executor) by deed, that I will not take charge of the administration on myself, and then I sue to the Ordinary to be charged, etc., and my companion (fellow executor) sues an action of Covenant on the deed against me here, he will not have a Prohibition, etc., because his suit here is on a temporal act, and my suit to the Ordinary is for a spiritual thing, so, etc.; and also if I grant to one by my deed, that I will not sue in Court Christian to have one such to wife (to marry, a feme), and then I sue in Court Christian to have her as my wife, and the other (my grantee) sues an action of Covenant against me here, he will not have a Prohibition, for the reason aforesaid (causa qua supra), and so here, the suit in Court Christian is for a spiritual thing, and the suit that is here is on a temporal composition
Choke JCP: one cannot prescribe for no tithes (in non decimando), but for a manner of tithes (in modo decimando) he can well prescribe, and in this case if the parson had land for his tithes, then he is satisfied, because he had quid pro quo, and Sir, if a parson leases to me by deed all the tithes of his benefice, and then for tithes of my own lands, I sue in Court Christian, and I bring an action of Covenant against him here, I will not have a Prohibition, because I can plead my bar against the parson there in Court Christian for his tithes, in this case this composition was made before time immemorial, and this prescription they (Court Christian) ought not try, because their prescription and ours (our prescription) are different, because prescription in spiritual law is a continuance of possession for 10 years or 20 years, etc., so if this action was brought on a composition made before time immemorial, so that it could be pleaded there in bar, it seems to me that they will not have Prohibition, but because it is done before time immemorial, and they cannot try this prescription, etc., so it seems to me that prohibition lies, and that he will be tried here, etc.
Danby CJCP: we cannot know if this be sufficient discharge of tithes or not, etc. and Sir, if a parson grant me that I will be discharged of tithes, and then he sue against me for the tithes, and I bring an action of Covenant here against him, I will not have a Prohibition, because my action here is becaue he has acted contrary to his deed, which is a temporal thing, for which I will recover damages, and if it be so that he had lands for his tithes, you can plead your matter there in the Court Christian, etc.
and the Serjeants said that they did not want to accept any plea in answer in the Court Christian, etc.
Moyle JCP: there are only a few cases in which one recovers damages for vexation of suit, etc., except this and others which are gieven by special law, as Appeal and Quare impedit, etc. |
