quod Nedeham JCP concessit
Sjt Catesby (continuing): & quant il justifie le aler en tiel voy, il covient monstrer que il est le hault chimyn le Roy, & ad estre de temps d' ont memory, &c.
& issint Sjt Catesby en un justification,
& le plaintiff dit que homes ont ascun foits ale per cesty voy per le licence, &c. del plaintiff, & ascun foits pur lour dever, &c. sans ceo que il ad estre le hault chimin le Roy de temps, &c. |
all the Justices: in the king's highway (in regia via), the king has only passage for himself and for his people, but the freehold and all the profits, such as trees, etc., are (belong) to the lord of the soil
Sjt Catesby (for D): if a nuisance be committed by raising an embankment (fosse), etc. the king ought to make the punishment, and the lord of the soil will have an action for flooding (pur foder) of the land, etc.
which Nedeham JCP agreed,
and when he justified going (le aler) on such way, he ought to show that it is the king's high road, and had been from time immemorial, etc.
and so Sjt Catesby (for D) (pleaded) in a justification
and the plaintiff replied that folk (homes) had sometimes gone by that way by the licence of the plaintiff and sometimes for their duty (?) (dever), etc., denying that this had been the king's high road from time immemorial |
