Defendant pleaded that there was no such vill, nor hamlet, nor place known outside of a vill or hamlet, within the county by the name plaintiff counted.
Plaintiff replied that there was such a hamlet within the county.
Defendant argued that plaintiff's writ could only be brought for land wihin a vill.
Plaintiff argued that his writ was sufficient.

Danby JCP (to Sjt Nedeham): Voules vous changer l' ancien cours de voz livres (= Year Books)?; Car en vostre livres (= Year Books) vous trouveres ajuge, si un Praecipe quod reddat soit porte de terre en un hamel, ou dehors, mes que soit en un ville, n' est my bon, &c.
Sjt Nedeham (for P): Verament si, jeo n' ay veu unques tiel Jugement, en mes livres (= Year Books) come vous parles |
Moyle JCP: in an Assize it is good, if the tenements be in a hamlet or a place known (outside of the vill and hamlet), because he will recover by view of the jurors, etc. and also in a writ of Dower, because it does not demand any certain tenements, but Reasonable dower (rationabilem dotem), etc. (is otherwise), and also in a writ of Trespass (category?); but this Praecipe quod reddat is a writ of right (category), which ought to be supposed (to demand land) in a certain vill, etc.
Danby JCP: (to Sjt Nedeham (for P) Do you want to change the old course of your books (= Year Books)?; because in your books (= Year Books) you will find it adjudged, that if a Praecipe quod reddat be brought for land in a hamlet, or outside (a vill or hamlet), even though it (the land) be in a vill, it (the writ) is no good, etc.
Sjt Nedeham (for P): truly Sir, I have never seen such a judgment in my books (= Year Books) as you say (parles) |
