Plaintiff widow executor counted that the testator in the county where the writ was brought, leased to defendant a messuage (meas) with appurtenances in London for a term of years, and that the rent was in arrears for 4 years.
Defendant pleaded that at the end of the 4 years, the testator at London commanded defendant to repair several houses (measonz) part of the same messuage (meason) with the sum in demand, so defendant repaired them and expended the sum in demand in the repair.
Moyle JCP argued that this was no plea.
Sjt Choke argued that this was a good plea.
Danby JCP and Danvers JCP and Prysot CJCP all argued that this was no plea.
Prysot CJCP suggested that it would perhaps be a better plea if defendant pleaded that at the time of the lease the large timbers of the house were so weak and rotten that they could not last much longer, and that the testator commanded defendant to repair with large timbers.
Defendant pleaded by the form that Prysot CJCP suggested, that the large timbers at the time of he lease were rotten, etc. and that the lessor commanded him to repair.
Plaintiff demurred to the plea. |

Moyle JCP: en cest cas le party le lessee est oblige de paier ou la terre est per doubt (= fear) d' un distrese, purqui en cest cas si le lessor luy veut distreine, il purra bien tendre les deniers ou la terre est; mes auterment est en vos autres cases, le defendant est compelle de payer le monnoie en quiconque lieu que soit demande; si le lessor ust demande le rent en ascun autre lieu forsque sur la terre, le lessee n' est my coarcte (= compelled) de luy paier, & sera recte sa foly (= accounted his folly) s' il issint fait; le plaintif sera barre per son fait de mesne (should be 'demesne'); car ceux demesme (should be 'de mesme') la Countie purront aver conusance del' dutie, si soit paie per la forme, mes cues d' un auter Countie ne purront aver notice s' il soit ou nemy: purque le special issue sera pris
Danby JCP: il ad plede que le testator luy commande de reparer la meason, &c. la quel chose il n' est my compeller de faire; car ceo n' est forsque un labeur per luy, & auxi s' il seroit ple, uncore il covient de monstrer en certain coment il ad expende le deniers, s. pur mettre chescun chose en certain, &c. issint n' ad il fait, &c.
Danvers JCP: ou le defendant ad monstre que le testator commanda luy de reparer la meason, cest commandement n' est a purpos mes que il aura ascun eontent: car pur ascun chose que est monstre icy il est chargeabla de waste: sic hic: ergo il mesme est tenu ove fine force (= by absolute necessity) de reparer la meson
Prysot CJCP: come est en le Statut de labeurers, &c.; Et si le servant fait covenant en un County, le Maistre poet eslire de prende accion en l' un County ou en l' auter County, & issint le servant aura brief de dette envers son Maistre en quel des Counties que il voillet auxi, &c.; Issint d' un leas 'mutatis mutandis', &c.; si le condicion soit que il paye a Pauls en la Citie de Londres, &c. uncore s' il paye en ascun auter lieu, il sera discharge, car ceo n' est de payer le principal deuty (= debt) del' obligation, mes de paier un peyne (= penalty), la quel n' est mes un accessory, &c.; Mes sur l' arrerages d' accompt il est charge de paier le principal somme, le quel covient estre en meme le lieu ou l' accion fuit pris, &c.; Mes s' ils voulent dire que le grande timber del' meason al' temps del' leas fuit fait enfoible (= weak) & putrifie (= rotten) que il ne poet plus long temps endure, adonques peraventure si le lessor ust commande le defendant a reparer le meason ove grande timber, &c.

Sjt Choke argued for defendant's position
Danby JCP: he (defendant) has pleaded that the testator commanded him to repair the house, etc. which thing he was not compelled to do, because this is only a labour for him, an also if it were a plea, yet he ought to show with certainty how he had spend the money, tht is, to put each thing in certainty, etc.
Danvers JCP: where the defendant had shown that the testator commanded him to repair the house, this command is irrelevant (n' est a purpos) ... because for another thing that is shown here he is chargeable for waste ... thus he himself is held by absolute necessity (ove fine force) to repair the house
Prysot CJCP: in a writ of Detinue if I bail to one in one county, and he dies in another county, and the goods or charters come to the hands of his executors in the other county, in this case I can choose to take my action in the one county or in the other, as it is in the Statute of Labourers, etc.; and if the servant made a covenant in one county (to serve in another county), the master can chose to take an action in one county or in the other county, and so the servant will have a writ of Debt against his master in whichever of the counties he wants also, etc; thus of a lease 'mutatis mutandis'; if the condition be that he pay at St. Paul's in the City of London, etc. yet if he pay in any other place, he will be discharged, because this is not to pay the principal debt (deuty) of the obligation, but to pay a penalty (un peyne), which is only an accessory; but if they would say that the large timbers of the house at the time of the lease were so weakened (enfoible) and rotten (putrifie) that they could not endure longer, then perhaps if the lessor had commanded the defendant to repaid the house with large timber, etc. and if he plead this, perhaps it would be better |
