Tenant (defendant) vouched two to warrant.
Demandant (plaintiff) replied that since the gift of which tenant vouched, another was seised of the same land in demand and thus seised enfeoffed the two vouchees by maintenance, denying that the two vouchees or any of their ancestors whose heirs they are ever had any other estate in the land since the gift.
Tenant (defendant) said by protest that demandant's counterplea was insufficient, and tenant rejoined that the two vouchees were enfeoffed in good faith, denying that they were enfeoffed for maintenance.
Newton CJCP warned tenant's counsel that he seemed to be with demandant on this counterplea, because tenant's rejoinder would be overruled, and that this was tenant's own delay. |

(for P): by the statute of Richard (= 1 Ric. 2 (1377), ch. 9) it is now ordained that if anyone enfeoff another of any land by maintenance or to defraud those who have right to the land to miscontinue their tenant, that such feoffment will be void
Sjt Portyngton (for D) said by protest that this counterplea was not sufficient and pleaded (rejoined) that the said H. enfeoffed the two (vouchees) in good faith (bona fide) denying that he enfeoffed the two (vouchees) for maintenance
Newton CJCP: look out (gardes bien) that you are with demandant on this counterplea (humour), because I myself was in the same case and by advice of all the Court I was overruled (ieo foye rule oustre), and this is your own delay |
