Process and Pleading
Tenant (defendant) vouched two to warrant.
Demandant (plaintiff) replied that since the gift of which tenant vouched, another was seised of the same land in demand and thus seised enfeoffed the two vouchees by maintenance, denying that the two vouchees or any of their ancestors whose heirs they are ever had any other estate in the land since the gift.
Tenant (defendant) said by protest that demandant's counterplea was insufficient, and tenant rejoined that the two vouchees were enfeoffed in good faith, denying that they were enfeoffed for maintenance.
Newton CJCP warned tenant's counsel that he seemed to be with demandant on this counterplea, because tenant's rejoinder would be overruled, and that this was tenant's own delay.
