The inquest remained for lack of jurors.
Defendant prayed Octo Tales to be returned Trin. 1443.
Plaintiff prayed for a longer adjournment (pluis longe jour).

the Justices did not want to make the one (prospective juror challenged) of the one (party's) challenge and another (prospective juror challenged) of the other (party's) challenge to be triors, because it could well be that the plaintiff challenged one juror who was of his assent (favourable to plaintiff? AbrBkAss suggested favourable to defendant), and so it appeared a trick (une cautele, or a precaution, MLF)
Fitzherbert Challenge 38 ended: it was awarded according to defendant's prayer because it was in a Replevin, and each (party) was 'actor' against the other, and the defendant is the better suitor because he demands the shortest day (adjournment), but it would have been the contrary in another action
