Defendant pleaded that the king was seised of the forest, that the forester (?) killed two wild animals, that defendant as deputy came to arrest plaintiff, that plaintiff saw defendant and fled to the place, that defendant chased plaintiff there and took and imprisoned him
Plaintiff replied that this was no plea because first defendant did not show how the forester came to be forester; because defendant did not show that he could be made deputy, because defendant did not show that the place where he took plaintiff was within the forest, because defendant did not show that the forest was in the same county where the writ was brought, and because defendant did not show in what county he took plaintiff.
The opinion of the Justices was that the plea was no good. |

Wangford: ceo n' est ple pur plusourz causez quar adeprimes il monstra que un D. est forester & il ne monstra coment il est forestere & il ne peut estre forester sinon per graunt le roy ou per prescripcion; Et auxint il dit que il come depute le dit D. & ne monstre que il puit faire depute sinon que son graunt de son office face mencione de cest &c. sinon en especialle casez come une vicount &c.; Et auxint il dit que il luy prist in quodam loco &c. & ne dit que meme le lieu est deinz le forest & may conceit il nest loialle de luy prendre hors del forest sinon que il ust este possesse de luy come si un vicount vient pur arrester une home & il fua en autre comitate le vicount ne luy puit prendre; Mes sil luy arreste issint que il soit une foitz en son garde & puis il fua en autre comitate il est loialle peut le vicount de luy prendre quar il sera dit tout temps en son garde mes il nad pas monstre que il ad ly arreste / mez dit que il vient pur luy arrester &c.; Et auxint il ne monstre que le forest est en meme le comitate lou le brief est port & auxint il ne monstre en quel comitate cel lieu appelle Swag est;

Wangford: (one) cannot be forester except by grant of the king or by prescription; to my thinking (conceit) it is not lawful for him (a sheriff) to take (one) out of the forest unless he had possessed him (within the forest), as if a sheriff came to arrest one andhe fled into another county, the sheriff could not take him; but if he arrest him so that he be once in his custody (garde), it is lawful for the sheriff to take him because he will always be said to be in his custody (garde) but he has not shown that he had arrested him (in the forest); but he said (only) that he came to arrest him |
