Process and Pleading
The record stated that an Exigent issued.
The record stated that the Exigent was delivered to the sheriff.
Plaintiff showed that the writ was embezzled, and prayed that the sheriff be amerced for the king.
The sheriff was amerced 100 shillings for this falsehood.
Plaintiff showed that the record stated that before issuance of the Exigent, a Habeas corpora was delivered to another sheriff.
At Nisi prius the Justices demanded that the second sheriff return the Habeas corpora.
The second sheriff would not make return of the Habeas corpora, but said that the Justices could make it if they wanted.
The second sheriff was amerced 40 pounds for disobedience and malice.
